ESTATE PLANNING

Our law firm joins with your accountant, financial advisor, and banker as part of a professional advisory team. We suggest you allow us to involve your other advisors in the estate planning and strategy development process. This permits all of your advisors to be fully informed and the opportunity to offer their particular expertise to the process. Estate planning and asset protection are complex fields which are constantly evolving due to the needs of our clients’ and changes in laws. We focus on developing effective estate plans, customized legal documents, and asset protection strategies that are tailored to meet your individual needs and objectives. We carefully guide our clients through the information gathering, planning and strategy development, and funding and documentation processes to ensure their current and future goals are met. We assist clients with the preparation of wills, trusts, powers of attorney, healthcare documents, deeds, business succession planning, family limited partnerships, charitable planning vehicles, and estate tax planning to preserve wealth for future generations, and arrange their personal and business affairs with minimal taxation and maximum asset protection. In representing our estate planning clients, we understand the complexity, challenges, and emotions that are related to protecting and transferring your corporate and personal assets.

We also understand the challenges of owning and operating a successful business enterprise. As a key member of your planning team, we are well aware of your priorities and have the extra skills and training to help you understand and implement the asset protection, estate planning, and business planning options that are best suited for you.

ELDER LAW, GUARDIANSHIPS, AND CONSERVATORSHIPS

At the Law Offices of Richard J. Reilly Jr., we focus on guiding families through the complex issues of elder law and asset protection planning, while helping them make informed choices to meet their needs. It is also important to consider that decisions made in one area of an elder's life can have unintended consequences in another.

As part of our practice we develop plans to help senior citizens and disabled individuals preserve their assets and protect their family from the astronomical cost of nursing home and long-term care. It is never too early or too late to begin planning, even if someone is already in a long-term care facility.

Our goal is to assist families in developing and implementing life plans that avoid probate and guardianship; plan for the possibility of long-term care; and protect their life savings if a nursing home is needed. To reach appropriate answers and decisions, we take a multidisciplinary approach that involves determination of Mass Health eligibility; drafting of wills and trusts, powers of attorney, and healthcare documents; special needs planning; and estate planning. We can also provide financial professionals and assisted living and nursing home recommendations for senior citizens.

MASSACHUSETTS PROBATE AND ESTATE ADMINISTRATION SERVICES

Our services include formal and informal probate administration, ancillary probate, trust administration, and estate settlement. The firm is involved in all aspects of estate, probate and trust administration, including the asset distribution; handling creditors; beneficiary rights'; preparation of the federal and state estate and fiduciary income tax tax returns; and complex postmortem estate planning.  Attorney Reilly has the requisite experience to handle all probate and estate matters to settle an estate.

PROBATE LITIGATION

Attorney Reilly represents both beneficiaries and fiduciaries such as conservators, guardians, executors, and trustees in disputes involving Trusts and estates. We handle

  • Will contests
  • Claims of undue influence
  • Lack of mental capacity
  • Trust Litigation, including Trust contests and Trust Reformation & Reconstruction
  • Estate Litigation

Our firm also handles guardianships for minors, general business and corporate matters, and real estate transactions for a range of clients.

If you need legal assistance that is outside of the scope of Attorney Reilly’s practice you may still call the firm and get a referral at no cost. We can also recommend a number of financial professionals, investment advisors, and accountants for our clients to assist with their needs.
